The only individuals who can provide you with immigration legal advice are attorneys and BIA Certified Legal Representatives. These are the individuals who have been authorized by the State of Indiana or the federal government to practice law and provide legal representation as it relates to immigration. Notarios Publicos and Tax Preparers do not have the legal training or authority by the state or federal government to practice immigration law in the State of Indiana or before federal agencies or courts.
What’s the Harm?
Trusting Notarios Publicos and Tax Preparers to provide immigration advice can have extremely detrimental effects on your case. They are not authorized to represent your legal interests in the United States Immigration Court or before the U.S. Citizenship and Immigration Services (“USCIS”). If something goes wrong with your application, they cannot communicate with USCIS or with any other federal agent as your legal representative, because they do not have any legal duty to you or to your case, and they are not recognized by USCIS or the Immigration Court.
How to Know Who to Go to?
If you ever have questions about the person who is offering you their services, there are easy ways of confirming the person’s credentials.
Attorneys: In the State of Indiana, you can always go to the Indiana Roll of Attorneys (link below) and use the person’s first name, last name, and city where they practice to see whether the person is licensed to practice law in the State of Indiana.

Accredited Representatives: Accredited representatives are individuals associated with non-profit organizations who have permission from the U.S. Department of Justice to represent individuals in Immigration Court or before USCIS. These individuals and organizations follow strict guidelines and undergo strict oversight to function in their representative roles. What to do when you encounter a Notario Publico?
The State of Indiana has taken steps to stop the rise in Notarios Publicos who conduct themselves as attorneys or legal representatives. If you go to someone who inappropriately offers you legal services, legal advice, or offers to help you prepare legal applications, you can help stop them from committing fraudulent activity by reporting them to the Secretary of State’s office by preparing and sending the form below.
