New law addresses non-compete provisions in physician employment contracts

Indiana law now requires specific terms in physician contracts that include non-compete provisions. All physician employment contracts entered into after July 1, 2020 are required to include an opportunity for the physician to buy out of the non-compete restrictions.  Also, a physician departing employment must be given a copy of the notices sent to patients.  This new law applies to medical doctors, but it does not apply to Nurse Practitioners and other types of health care providers.  Also, the new law does not address provisions limiting solicitation of patients or employees.  Community Health Centers have many additional considerations when preparing employment contracts with providers.  Lewis Kappes regularly advises health care providers and employers of health care providers regarding employment agreements, including the new legislation in Indiana.
